Appeals court halts gay marriages in Michigan
Elite Lawyers | 2014/03/24 11:05
Same-sex couples rushed to Michigan county clerk's offices Saturday to get hitched a day after a judge overturned the state's constitutional ban on gay marriage, and several hundred managed to do so before an appeals court reinstituted the ban, at least temporarily.

The order by a federal appeals court in Cincinnati came after Glenna DeJong, 53, and Marsha Caspar, 51, of Lansing, were the first to arrive at the Ingham County Courthouse in the central Michigan city of Mason. DeJong and Caspar, who have been together for 27 years, received their license and were married by Ingham County Clerk Barb Byrum.

"I figured in my lifetime it would happen," Caspar said. "But now, when it happens now, it's just overwhelming. I still can't believe it. I don't think it's hit me yet."

Similar nuptials followed one after another, at times en masse, in at least four of Michigan's 83 counties. Those four - Oakland, Muskegon, Ingham and Washtenaw counties - issued more than 300 marriage licenses to same-sex couples Saturday.

DeJong said the threat of a stay was all the encouragement they needed.

"Come Monday, we might not be able to do it, so we knew we had a short window of time," she said.

She was right. Later Saturday, the 6th U.S. Circuit Court of Appeals froze until at least Wednesday a decision by a lower court judge to overturn Michigan's ban. The appeals court said the time-out will "allow a more reasoned consideration" of the state's request to stop same-sex marriages.

The court's order was posted just a few hours after it told the winning side to respond to Michigan Attorney General Bill Schuette's request for a stay by noon Tuesday.

In his appeal, Schuette noted the U.S. Supreme Court in January suspended a similar decision that struck down Utah's gay-marriage ban.

3 California men plead guilty in alleged pot grow
Elite Lawyers | 2014/03/10 13:22
Three Northern California men are each facing up to ten years in prison after pleading guilty to charges that they damaged federal conservation land while allegedly growing marijuana.

Prosecutors say Chou Vang, Vang Pao Yang and Pao Vang, all of Eureka, each entered their pleas in federal court in San Francisco on Tuesday to one count of willful injury to federal property.

The men were accused of clearing away trees and vegetation, using fertilizers, and failing to properly dispose of trash while growing pot in the summer of 2012 in the King Range National Conservation Area along California's Lost Coast. The area provides habitat for four federally-listed threatened species, including Chinook and Coho salmon.

As part of a plea deal, prosecutors say they dropped marijuana cultivation charges. The men are scheduled to be sentenced in July.

Case dropped against NY lawyer in alleged attack
Elite Lawyers | 2012/09/14 10:18
Charges have been dropped against a prominent New York lawyer who was accused of attacking a woman in a Connecticut restaurant.

The Advocate of Stamford reports that Albert J. Pirro's lawyer said the state indicated it would not prosecute. Charges were dropped in Stamford Superior Court on Tuesday.

A spokesman for the state's attorney's office did not immediately return a call Wednesday.

Police say Pirro grabbed and shook a woman in a Greenwich restaurant last June. He was charged with unlawful restraint and disorderly conduct.

Pirro, a Republican fundraiser, is the estranged husband of Jeanine Pirro, a former Westchester District Attorney who is now a legal analyst with Fox News.

Albert Pirro spent 17 months in prison after being convicted of fraud, tax evasion and other charges in 2000.

Class action or a representative action is a form of lawsuit in which a large group of people collectively bring a claim to court and/or in which a class of defendants is being sued. This form of collective lawsuit originated in the United States and is still predominantly a U.S. phenomenon, at least the U.S. variant of it. In the United States federal courts, class actions are governed by Federal Rules of Civil Procedure Rule. Since 1938, many states have adopted rules similar to the FRCP. However, some states like California have civil procedure systems which deviate significantly from the federal rules; the California Codes provide for four separate types of class actions. As a result, there are two separate treatises devoted solely to the complex topic of California class actions. Some states, such as Virginia, do not provide for any class actions, while others, such as New York, limit the types of claims that may be brought as class actions.
