Lawyers from LGBT group to join Supreme Court bar

An organization of gay and lesbian lawyers says 30 of its members will be sworn into the Supreme Court bar in a courtroom ceremony next week. The National LGBT Bar Association says it's the first time it will take part in the mass swearing-in that occurs on most days the court is in session. Association executive director D'Arcy Kemnitz said many members already will be in Washington for President Barack Obama's inauguration on Monday. They'll be sworn in Tuesday. By custom, a Supreme Court lawyer vouches for prospective members, and Chief Justice John Roberts welcomes them before they swear to support the Constitution. Openly gay lawyers already practice before the Supreme Court, but Tuesday will mark the first time lawyers will be identified at the ceremony as LGBT Bar members. |

Venezuela court could decide on Chavez swearing-in

The president of Venezuela's Supreme Court said Thursday that it could decide whether it's constitutional to postpone the date of ailing President Hugo Chavez's swearing-in as he recovers from cancer surgery in Cuba.
Supreme Court President Luisa Estella Morales also said the matter has not yet been brought before the court. Chavez is due to be sworn in for another six-year term on Jan. 10, but complications after his Dec. 11 surgery and his silence after the procedure have thrown into doubt whether he will be capable of taking the oath of office.
"At this time, there is no constitutional question to resolve," Morales said at a news conference. "When the matter is brought up, if it's brought up, then it will be the Constitutional Chamber of the Supreme Court of Justice that will decide."
The justice's remarks came after National Assembly President Diosdado Cabello suggested on Tuesday that Chavez's inauguration could be postponed — a statement that has fed uncertainty about the his prospects of recovery.
Cabello defended the idea in a message Thursday on his Twitter account, saying: "I only expressed my opinion, of which I'm absolutely convinced since it's in line with our constitution." |

Retail group against revised card settlement

A proposed settlement in a class-action lawsuit brought by retailers and trade groups against Visa Inc. and MasterCard Inc. fails to protect merchants from abuse by credit card companies, a national retail group says.
The lawsuit, which dates to 2005, centers on the subject of swipe fees — charges banks collect every time a Visa or MasterCard is used to pay for a purchase.
The proposed settlement terms, initially disclosed in July, were revised and filed Friday with U.S. District Court in Brooklyn.
But changes to the deal failed to win over many of the retailers represented by the National Retail Federation.
In a statement Mallory Duncan, the trade group's general counsel, said that the proposed deal does virtually nothing to protect retailers or their customers, and it attempts to silence any objections for years to come.
"Retailers would rather take their chances in court than accept this one-sided swindle written by the card industry for the card industry," he added.
The National Retail Federation, the nation's largest retail trade group, is not a party to the lawsuit.
In a statement Friday, Visa called the settlement a fair and reasonable compromise.
Under the proposed settlement, stores will be allowed to charge customers more if they pay with a credit card. The pact covers only U.S. transactions. |

Class action or a representative action is a form of lawsuit in which a large group of people collectively bring a claim to court and/or in which a class of defendants is being sued.
