Court schedules night deer hunting arguments

Wisconsin's Chippewa tribes will get a chance next month to tell a federal appeals court why members should be allowed to hunt deer at night.State officials have long banned night hunts out of safety concerns.

U.S. District Judge Barbara Crabb ruled in the early 1990s that the ban applies to Chippewa hunters.The tribes asked Crabb in 2012 to reconsider her decision but she refused.

The Chippewa have since asked the 7th Circuit Court of Appeals in Chicago to allow tribal night hunts, arguing night hunting has become more common and the state can't argue it's unsafe.

The court has set oral arguments for Sept. 16. The tribes and state attorneys will each get 20 minutes to speak. It's not clear when the court might rule.

Law firm: Phoenix lawyer dies from shooting wounds

A lawyer wounded by a gunman in a Phoenix office shooting this week has died, the second of three people hit by gunfire in the attack, the publicist for his law firm said Friday.

Mark Hummels, 43, had been on life support at a Phoenix hospital after Wednesday morning's shooting that killed a company's chief executive and left a woman with non-life threatening injuries.

Colleagues of Hummels described him as a smart, competent and decent man who was a rising star in his profession and dedicated to his wife, 9-year-old daughter and 7-year-old son.

The gunman — Arthur Douglas Harmon, 70 — was found dead early Thursday in the Phoenix suburb of Mesa from an apparent self-inflicted gunshot wound, police said.

Harmon opened fire at the end of a mediation session at a north-central Phoenix office building over a lawsuit he filed last April.

Steve Singer, 48, a father of two and CEO of Scottsdale-based Fusion Contact Centers LLC, died hours after the shooting.

Harmon targeted Singer and Hummels and "it was not a random shooting," police said. A 32-year-old woman not involved in the mediation was caught in the gunfire near the building entrance and suffered a gunshot wound to her left hand.


Convicted financier says he can't afford a lawyer

An Indiana financier and former chief executive of National Lampoon who was convicted of swindling investors out of about $200 million says he can't afford to hire an attorney to handle his appeal.

In federal court documents filed Monday, Timothy Durham said his multimillion-dollar Indianapolis home is in foreclosure and all of his financial assets are tied up bankruptcy proceedings of the companies he used to control.

Durham's home in Fortville, Ind., about 20 miles northeast of Indianapolis, has a $5 million mortgage but a free-market value of only $3 million, according to the documents.

Durham says his only income this year was $6,000 he received as a director of Dallas-based insurer CLST Holdings Inc. He also has stock in CLST and National Lampoon, the documents say.

Durham was sentenced to 50 years in prison last month on securities fraud and other convictions in the collapse of Akron, Ohio-based Fair Finance. He also was ordered to pay $202.8 million in restitution. Durham received credit for $6 million that already has been recovered.

Durham and two business partners were charged with stripping Fair Finance of its assets and using the money to buy mansions, classic cars and other luxury items and to keep another Durham company afloat. The men were convicted of operating an elaborate Ponzi scheme to hide the company's depleted condition from regulators and investors, many of whom were elderly.

Defense lawyers argued that Durham and the others were caught off-guard by the economic crisis of 2008, and bewildered when regulators placed them under more strict scrutiny and investors made a run on the company.

American Association for Justice Announces Waters, Kraus & Paul Partner as President-Elect

Gary M. Paul, a longtime champion of victims’ rights and a partner with one of the nation’s most prolific plaintiff’s firms, has risen through the ranks of the American Association for Justice (AAJ) to be named president-elect of the organization. Mr. Paul will take office as AAJ president in July 2011.

Mr. Paul is a partner in the Los Angeles office of Waters, Kraus & Paul—the West Coast practice of Waters & Kraus. Nationwide, Waters & Kraus has taken more asbestos-related trials to verdict than any other plaintiff’s firm. In addition, Mr. Paul has more than three decades of experience in complex civil cases ranging from product liability to medical malpractice. Longtime civil rights lawyer William Taylor dies

William L. Taylor, a Washington lawyer and civil rights activist who fought in courts and in government to desegregate schools, has died. He was 78.

His oldest daughter, Lauren Taylor, says he died Monday of complications from a fall.

Taylor began advocating for civil rights while working for the NAACP Legal Defense and Educational Fund alongside Thurgood Marshall.

Taylor served as general counsel and staff director to the U.S. Commission on Civil Rights during the Kennedy and Johnson administrations. He led research that contributed to the 1964 Civil Rights Act, the 1965 Voting Rights Act and the 1968 Fair Housing Act.

In the 1980s, he led negotiations that established a voluntary school desegregation plan in St. Louis.

Class action or a representative action is a form of lawsuit in which a large group of people collectively bring a claim to court and/or in which a class of defendants is being sued.
