Appeals court halts gay marriages in Michigan

Same-sex couples rushed to Michigan county clerk's offices Saturday to get hitched a day after a judge overturned the state's constitutional ban on gay marriage, and several hundred managed to do so before an appeals court reinstituted the ban, at least temporarily.

The order by a federal appeals court in Cincinnati came after Glenna DeJong, 53, and Marsha Caspar, 51, of Lansing, were the first to arrive at the Ingham County Courthouse in the central Michigan city of Mason. DeJong and Caspar, who have been together for 27 years, received their license and were married by Ingham County Clerk Barb Byrum.

"I figured in my lifetime it would happen," Caspar said. "But now, when it happens now, it's just overwhelming. I still can't believe it. I don't think it's hit me yet."

Similar nuptials followed one after another, at times en masse, in at least four of Michigan's 83 counties. Those four - Oakland, Muskegon, Ingham and Washtenaw counties - issued more than 300 marriage licenses to same-sex couples Saturday.

DeJong said the threat of a stay was all the encouragement they needed.

"Come Monday, we might not be able to do it, so we knew we had a short window of time," she said.

She was right. Later Saturday, the 6th U.S. Circuit Court of Appeals froze until at least Wednesday a decision by a lower court judge to overturn Michigan's ban. The appeals court said the time-out will "allow a more reasoned consideration" of the state's request to stop same-sex marriages.

The court's order was posted just a few hours after it told the winning side to respond to Michigan Attorney General Bill Schuette's request for a stay by noon Tuesday.

In his appeal, Schuette noted the U.S. Supreme Court in January suspended a similar decision that struck down Utah's gay-marriage ban.

French court blocks secret recordings of Sarkozy

A French court has ordered an ex-aide of Nicolas Sarkozy to pay 10,000 euros ($14,000) in damages and costs to the former French president over secret recordings that were published in an online journal, and instructed the publication to pull down the links.

Sarkozy and his pop-star-supermodel wife, Carla Bruni, had demanded an emergency injunction blocking publication of their conversation, which surfaced in the online publication Atlantico. The court Friday ordered Atlantico to take down the audio files.

Once-trusted aide Patrick Buisson was ordered to pay 10,000 euros in damages to Sarkozy for making the recordings, and Atlantico and Buisson were each ordered to pay 1,000 euros in court costs.

Atlantico has already pulled the playful exchange between Sarkozy and Bruni.


Court ruling could delay California water project

A state appellate court has ruled that California water officials cannot go onto private property for soil testing and other studies related to construction of two massive tunnels that would siphon water from the Sacramento River.

Nancy Vogel of the state's Department of Water Resources said Friday that officials anticipated the ruling and work won't be delayed.

The decision handed down Thursday by the state's 3rd District Court of Appeal says an intrusion on private property without permission violates the California Constitution.

If built, the Bay Delta Conservation Plan — estimated to cost billions of dollars — would send fresh water around the Sacramento-San Joaquin Delta to Central and Southern California.

The ruling stems from a lawsuit filed against the state by more than 150 property owners in Sacramento, San Joaquin, Yolo, Solano and Contra Costa counties.

The three-judge panel ruled 2-1 in a 44-page decision with the majority opinion saying the state must adhere to eminent domain laws, which give property owners the right to a jury trial to determine a fair payment for taking away their land.

Acts such as testing soil, observing or trapping animals either by driving onto property, using boats or going on foot amount to "taking" and trigger the need for eminent domain proceedings, the majority opinion said.


Court declines to take up Episcopal Church dispute

The Supreme Court has declined to wade into a dispute between the Episcopal Church and a conservative congregation that left the denomination in a rift over homosexuality and other issues.

The justices on Monday rejected an appeal from The Falls Church, one of seven Virginia congregations that broke away from the Episcopal Church in 2006 and aligned itself with the more conservative Anglican Church of North America.

The breakaway congregation in suburban Washington, D.C., claimed a right to keep the church building and surrounding property. But the Virginia Supreme Court ruled the Episcopal Church retained ownership of the historic church.

The Falls Church was one of seven Virginia congregations that left the Episcopal Church because of theological differences, including the 2003 consecration of an openly gay bishop in New Hampshire.
