Supreme Court takes up drug company dispute

The Supreme Court is wading into a patent dispute between rival pharmaceutical companies over a multiple sclerosis treatment.

The justices agreed Monday to hear an appeal from Teva Pharmaceutical Industries Ltd., which claims the U.S. Court of Appeals for the Federal Circuit wrongly overturned five of its patents for the drug Copaxone.

The appeals court ruling would allow rivals Mylan Inc., Momenta Pharmaceuticals Inc. and Sandoz, Inc., to start selling generic versions of the drug later this year, after the remaining patents on the drug expire.

A federal district court had earlier ruled in Teva's favor and upheld the patents. Teva says the Federal Circuit should have deferred to factual findings made in the district court.

The justices will hear the case in the fall.


Court seems likely to block Secret Service case

The Supreme Court appeared likely Wednesday to block a group of protesters from bringing free-speech claims against two Secret Service agents who were guarding President George W. Bush during a 2004 visit to Oregon.

The court's liberal justices seemed just as reluctant as the conservatives to find that the agents violated the protesters' First Amendment rights by moving them farther away from the president while allowing a separate group of pro-Bush demonstrators to stay a bit closer.

The protesters claim they were moved for loudly expressing their opinions while Bush was having dinner at an outdoor patio and not for any genuine security reasons.

Deputy Solicitor General Ian Gershengorn argued that agents who make on-the-spot judgments about the president's security should be shielded from liability.

"There are times when we don't want a reasonable official to hesitate before he acts and nowhere is that more important than when the specter of presidential assassination is in order," Gershengorn told the justices.

Michigan won't recognize same-sex marriages

Michigan won't recognize more than 300 same-sex marriages performed last weekend before a court halted a decision that opened the door to gay nuptials, Gov. Rick Snyder said Wednesday.

The announcement came a day after an appeals court indefinitely stopped any additional same-sex marriages. It will likely take months for the court to make its own judgment about whether a Michigan constitutional amendment that says marriage only is between a man and a woman violates the U.S. Constitution.
U.S. District Judge Bernard Friedman struck down the gay marriage ban Friday.

Four counties took the extraordinary step of granting licenses Saturday before the 6th U.S. Circuit Court of Appeals ordered a temporary halt. The stay was extended indefinitely on Tuesday.

Snyder acknowledged same-sex couples "had a legal marriage." But because of the court's stay, he added, the gay marriage ban has been restored.

The governor's move closes the door, at least for now, to certain benefits reserved solely for married couples. The American Civil Liberties Union said more than 1,000 Michigan laws are tied to marriage.

"We did our own homework and I believe this is a reasonable legal position to take based on the available literature and law," Snyder told reporters.

Other elected officials have urged the Obama administration to recognize the marriages for federal benefits. The U.S. Justice Department, which previously said it was monitoring the situation, did not immediately comment after Snyder's announcement.

Class action or a representative action is a form of lawsuit in which a large group of people collectively bring a claim to court and/or in which a class of defendants is being sued.
